No prison for woman whose baby died after she ate rat poison while ...

INDIANAPOLIS - Indiana prosecutors have dropped murder and attempted feticide charges against an Indianapolis woman who tried to kill herself by eating rat poison near the end of her pregnancy.

Bei Bei Shuai, 36, was charged in March 2011 with knowingly killing a viable fetus, prosecutors said.

Shuai walked out of Marion County Superior Court in Indianapolis a free woman on Friday after pleading guilty to a misdemeanor charge of criminal recklessness for the death of her newborn daughter, Angel.

She had been released from prison on bond in May 2012. Under the plea agreement, she did not have to serve more jail time.

"I have to say thank you to everyone who supported me before because without them, I'm not going to be able to continue to today," Shuai told reporters in footage posted on the Indianapolis Star website.

Shuai consumed rat poison while 33 weeks' pregnant in December 2010, prosecutors said. She was taken to a hospital where she admitted to attempting to kill herself after her boyfriend left her, according to a police statement.

Shuai's baby girl, Angel Shuai, was born alive, but died a few days after being taken off life support.

Shuai is from China and has no family members in the United States, according to her lawyer, Linda Pence.

Marion County Prosecutor Terry Curry said his office had always been willing to resolve the case for lesser charges. Earlier proposed deals had been rejected by the defense.

Curry said decisions by the trial judge about what could and could not be entered into evidence at the trial played a role in the negotiations.

Rare Dinosaur Find: Abandoned Nests with Eggshells

Huge meat-eating dinosaurs that stalked a vast floodplain some 150 million years ago in what is now Portugal left behind traces of their progeny: eggshells.

Some of the eggshells, which belonged to two Jurassic-Era theropods, or a group of carnivorous dinosaurs, once harbored embryos of Torvosaurus, the largest predator of its day.

"It was the equivalent of the T. rex in the Cretaceous," said study co-author Vasco Ribeiro, a paleontologist at the Universidade Nova de Lisboa in Portugal.

Ribeiro and his colleagues aren?t sure how the eggs came to be abandoned.

Delicate finds

Because they are so delicate, dinosaur eggs are a relatively rare find. Paleontologists unearthed some of the most primitive Torovosaurus embryos ever found earlier this year, and there have been occasional dinosaur nursery finds, including a clutch of hundreds of dinosaur egg fragments found in Spain. Ribeiro and his colleagues found the eggshell fragments at two separate sites, both of which were part of the Lourinh? Formation, a geological formation known for its rich Jurassic dinosaur nest sites. During that time period, the area was a floodplain that cycled through dry seasons and monsoon rains.

The eggshells were shattered and there was no trace of the dinosaur embryos that once coiled inside. But by analyzing the size, shape and texture of the eggshells, the team was able to deduce which animals left those eggs so long ago.

The shells found at one site came from spherical eggs that were about 6 inches (15 centimeters) in diameter. They likely belonged to a Torvosaurus, a massive, bipedal dinosaur that grew up to 36 feet (11 meters) tall.

The eggs at the other site were harder to identify. But the researchers believe the eggs may have contained embryos of Lourinhanosaurus antunesi, a theropod that was about 15 feet (4.5 m) long when full-grown. When intact, the eggs from that site would have been about 5 inches (13 cm) along the long axis and 3.5 inches (9 cm) along the short axis.

Neglected or protected?

The researchers don't know exactly how the eggs came to be abandoned.

One possibility is that the ancient carnivores laid many eggs and simply left those eggs to their own fates. Other researchers argue that these dinosaurs, like crocodiles, were attentive parents during embryonic development, guarding their clutches from predators.

Either way, once the hatchlings emerged, they were probably on their own, Ribeiro said.

"We have no evidence that mother dinosaur took food to the nest or protected the nest," Ribeiro told LiveScience.

Rain arrives in spells at St. Andrews

ST. ANDREWS, Scotland (AP) ? Inbee Park has some catching up to do if she wants to become the first golfer to win four professional majors in one year.

Miki Saiki of Japan twice holed out for eagle on the front nine Friday set the Women's British Open record at St. Andrews with a 6-under 66 in decent scoring conditions. She posted a 36-hole score of 9-under 35 and had a one-shot lead over Morgan Pressel, who had a 70.

The early starters had to cope with bursts of rain that were strong enough to leave puddles on the Old Course. It was so bleak at one point that Pressel said, "It looked like the world was going to end." But the wind was moderate. The rain kept the course soft. Low scores were available.

Park, who opened with a 69 on Thursday, headed out in tougher conditions in the afternoon.

The rain clouds were pushed away by a strong wind that stuck around St. Andrews, the strongest wind of the week. The Old Course can be a pushover in ideal conditions, and a beast when the wind blows.

Park opened with a bogey on the gentle first hole. She twice made par putts from the 5-foot range and got back the lost stroke with a birdie on the sixth to return to 3-under, six shots out of the lead.

Saiki's 66 broke by one shot the record set in 2007 by Lorena Ochoa, who won at St. Andrews, and by Saiki.

This round took a bit more luck.

She used an 8-iron from 127 yards on the fourth hole for an eagle, and then hit wedge into the hole from 108 yards on the seventh. Saiki made the turn in 30, and played even par on the back nine as the wind arrived for her 66.

Pressel missed a half-dozen birdie chances from inside 12 feet, including one on the 18th. She atoned for that by not dropping any shots on the back nine, which is more difficult. The longest par putt she faced as a 6-foot putt on the par-3 11th hole.

The Solheim Cup is on her mind, though Pressel figures to be a logical choice as a captain's pick even if she doesn't play her way onto the team. The Women's British Open is the final qualifying event before the matches in two weeks at Colorado Golf Club.

Now, the Floridian who has been playing majors since she was 13 can think about winning another one. Pressel won the Kraft Nabisco at age 18, the youngest player to win an LPGA Tour major.

"I've played well for two days, and I'm more focused on this tournament," she said.

Michelle Wie faced pressure without knowing it. She needs a good tournament to boost her chances as a captain's pick for the Solheim Cup, and after opening with a 74, the Stanford graduate ran off four birdies on the front nine Friday. She began losing shots on the back, however, and Wie had to make a 6-footer to escape with bogey on the 17th hole. It was playing so difficult that even with her length, she had 208 yards into the green.

Wie was 1-over for the tournament, right on the projected cut line, when she hit into 5 feet on the 18th hole. She didn't see U.S. captain Meg Mallon off to the side, breaking off a conversation to say, "This is a big putt," as she watched Wie. She poured it in for a 70 and was even for the championship.

Park has bigger goals.

No golfer, male or female, has ever won four professional majors in a single year. No one since the modern version of the Grand Slam was created in 1960 even had a chance at four in a row. The last golfer to win three straight majors in one season was Babe Zaharias in 1950, back when there were only three majors.

Calm as can be, Park's biggest test figured to be in the wind.

If you were wondering just how long it would take the Google Play Editions of the HTC One and Samsung Galaxy S 4 to get Android 4.3, we can now tell you: not long at all. Owners of both devices report that they're receiving over-the-air updates to the new OS. There isn't yet word of any GPE-specific additions, but we'll let you know if there are surprises in store.

Update: AnandTech has noticed a few GPE-specific changes. Most home screen icons appear larger, infrared now works on the HTC One, and Bluetooth-based internet tethering is now an option for the Galaxy S 4.

Update Sony Xperia Z to Android 4.3 Google Play Edition

The Google Play Edition Android 4.3 ? released with Samsung Galaxy S4 and HTC One Google Play editions ? custom ROM is now available to be flashed on Sony Xperia Z. This custom firmware for Xperia is based on Android 4.3 JB JSS15J build, rooted and is deodexed. This custom ROM will give you stock GE experience along with PIE and HALO features from ParanoidAndroid.

Prerequisites to update Sony Xperia Z to Android 4.3?Google Play Edition:

  • Backup any important data from your Sony Xperia Z as a complete wipe will be required during the flashing process.
  • Enable USB debugging option on your device:?Settings?>?Development?Options?>?USB debugging.
  • Your device must be rooted, unlocked and installed with a recovery tool like TWRP or CWM.
  • Your device must be charged to at least 60% of power.

Note:?the tutorial is only focused on Sony Xperia Z, please do not try it on other devices. This guide would be helpful for those users who want to try the new features of Android 4.3 JB.

How to update?Sony Xperia Z to Android 4.3 custom firmware:

  • Disconnect your device when copy is done.

Google's Moto X announced, gives us our second look at next generation iPhone 5S competitor

Google's Motorola subsidiary has just announced the brand-new Moto X, which they somehow let Verizon spoil last week with their incredibly similar new Droid announcement, but which is interesting enough that it certainly deserved the second, more encompassing look. Phil Nickinson of Android Central has already gotten a Moto X hands-on and here are his first impressions:

The Moto X is the first phone designed and built from scratch since Google acquired Motorola. And the end result is a phone that's as simple as it is complex. Its design is as understated as it is attractive. There have been so many assumptions about what the first Googlerola phone should be. It should be "Pure Google." It should have NASA-level hardware. It should have at least as many features as the droid line.

What Motorola's done is taken solid hardware and attractive design and married it to a fairly stock version of Android ? with some interesting features thrown in, as well as a number of customization options. It's coming to five U.S. carriers in a few weeks and worldwide later, retailing for $199 on contract.

It's not yet the Google+ Now phone of my dreams, the natural-language-first interface that brings the Iron Man movie's Jarvis one step closer to life, but it's certainly a great sounding phone. The customization options are interesting, if a little cheesy - it looks like you can get it in wood veneer! That's never worked for anyone before, not Dell, and not case makers, but Motorola seems to have a solid enough device here that the gimmick shouldn't matter. It's not lipstick on a pig, it's frosting on a cake.

Google will likely have a new Nexus (4?) later this year as well, and perhaps Android 5.0 Key Lime Pie (seriously?) to go with it. Combined, it'll be an interesting new generation of competition for Apple. We've already seen iOS 7, which really is revolutionary in its take on dynamic, gameified interface, but if Apple holds to pattern, they're in a "tock" cycle for hardware this year. Will an iPhone 5S be perceptively different enough to excite consumers, even with fingerprint scanners, better cameras, and other, less obvious enhancements?

Stocks open higher; S&P 500 cracks 1700-point barrier

Stocks opened sharply higher on Thursday, with the S&P 500 topping the 1,700-point mark, as Wall Street cheered upbeat economic data from China and Europe and a better-than-expected jobless claims report.

The Dow Jones Industrial Average was 118 points higher in early morning trading.

The S&P 500?rose 15 points to move through the 1700 barrier and the Nasdaq also rallied at the open. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, traded near 13.

Major averages closed out their best July since 2010 on Wednesday. For the year, the Dow and S&P 500 have spiked more than 18 percent for the year, while the Nasdaq has surged nearly 20 percent.

On the economic front, weekly jobless claims tumbled 19,000 to a seasonally adjusted 326,000, dropping to a 5-1/2 year low, according to the Labor Department. Economists surveyed by Reuters expected a reading of 345,000, compared with 343,000 in the prior week.

Also, the number of planned layoffs at U.S. firms declined modestly in July, with employers announcing 37,701 cuts last month, down 4.2 percent from 39,372 in June, according to the report from consultants Challenger, Gray & Christmas.

Meanwhile, the pace of growth in the U.S. manufacturing sector accelerated in July to the highest level in two years as new orders surged, according to a report by the Institute for Supply Management. The data supported the view the economy will pick up in the second half of the year.

The ISM said its index of national factory activity rose to 55.4 from 50.9 in June, topping expectations for 52. It was the highest since June 2011. New orders also racked up their best level in more than two years, jumping to 58.3 from 51.9.

The reports came ahead of Friday's widely-watched government jobs report. Analysts polled by Reuters expect to see a gain of 184,000 in July, after a 195,000 uptick in the previous month.

Stocks ended flat on Wednesday after the Federal Reserve did not signal when it would start tapering its bond-buying program. However, it did raise concerns about rising mortgage rates and flagged the risks of inflation falling too far below its target. In addition, the central bank slightly downgraded its outlook for economic growth.

Asian stocks rallied on Thursday after China's official PMI (purchasing manager's index) data showed the country's manufacturing sector continued to expand in July, defying forecasts of a contraction. But the picture was mixed, with a private gauge of factory activity by HSBC showing an 11-month low of 47.7 in July. Japan's Nikkei rallied to a one-month peak on the news, the Shanghai Composite hit a one-week high and South Korea's Kospi touched a seven-week high.

"Official PMI is more skewed to larger companies, and the HSBC figure reflects the smaller companies and that is where you get this divergence," said Frederic Neumann, co-head of Asian economics research at HSBC.

In Europe, the European Central Bank kept its main interest rate unchanged at a record low of 0.5 percent, and reiterated that rates would remain at present or lower levels for an extended period of time.

"Labor market conditions remain weak. Looking ahead to the remainder of the year and 2014, euro area growth should benefit from a gradual recovery in global demand," said ECB president Mario Draghi in a press conference following the announcement. "Our monetary policy stance remains accommodative for as long as necessary. We have unanimously confirmed the forward guidance we gave last time."

Euro zone manufacturing activity grew for the first time in two years in July, with the purchasing manager's index (PMI) climbing to 50.3 in July. A reading above 50 indicates an expansion.

And the Bank of England left its interest rates unchanged at 0.5 percent, as expected, under its new governor, Mark Carney.

Congressional Task Force Pins Worsening Wildfires on Climate Change

In a forum convened Tuesday by the Bicameral Task Force on Climate Change, a panel of experts on climate, wildfires, and forestry met with task force cochairs Rep. Henry Waxman, D-Calif., Sen. Sheldon Whitehouse, D-R.I., and other lawmakers to discuss the impact of climate change on wildfires.

"We've been experiencing wildfire activity that is different and more dangerous," Waxman said in his opening statement, calling recent fires some of the "largest and most intense ... we've seen."

Panelists cited a number of reasons for wildfire flare-ups, including land-use patterns and insect activity. But the discussion kept circling back to climate change.

"Scientists tell us these changes are not just random variability," Waxman said. "Bigger and more-intense fires are one of the red flags of climate change."

Climate-change expert William Sommers, a researcher at George Mason University's EastFIRE Laboratory, agreed. Sommers cautioned that rising levels of atmospheric carbon dioxide will only worsen wildfires in decades to come. "If current greenhouse-gas emission trends are not sharply reversed in the immediate future, we will see observed trends in wildfire risk accelerate," he warned.

Waxman and Whitehouse asked firefighting and forestry experts for policy recommendations to help mitigate the situation.

Panelists, including Santa Fe, N.M., Fire Chief?Erik Litzenberg and Rick Swan, director of supervisory personnel and health and safety for the California Department of Forestry Firefighters, cited budget cuts as a major stumbling block in efforts to combat wildfires, and called for increased funding for park services and firefighters.

"We are seeing a dramatic increase in the number of fires, especially in California," Swan said. "But we are not seeing the same increase in staffing levels and funding."

Litzenberg called on lawmakers to increase funding for the federal Volunteer Fire Assistance Grant program, noting that volunteers frequently serve as the first line of defense against wildfires.

Waxman and Whitehouse promised to consider the recommendations, but acknowledged that cutbacks due to sequestration would make funding increases difficult to achieve, at best.

Nevertheless, Waxman stressed that Congress cannot ignore the link between climate change and wildfires. "It's going to continue to get worse and ... this isn't the only problem that we're facing because of climate change," he said. "We've got to wake up the American people and their representatives and we've got to deal with this issue."
